SCAM MARRIAGE IN COLOMBIA TO OBTAIN U.S. VISA
My law firm keeps getting new clients all of them with the same story but with some minor changes.
Basically, they met online using tinder or Facebook a Colombian woman, and they fell in love, he kept sending cash and gifts while she was here in Colombia and they were dating. Without knowing each other, they decide to get married so man arrives to Colombia and couple gets tied up mostly in the first or second trip.
Once they start immigration process, difficulties and doubts start to my U.S. client, woman keep asking for more money and more offer, sometimes she doesn’t answer the calls or says she is tired, she is not sweet as before the wedding.
Once woman get U.S. visa and arrives to USA, in the next weeks, she starts making calls to unknown numbers, stay until late with new friends, while her husband is at home waiting or goes out with saying where.
At the end, without any notice, she goes home and takes her stuff and leaves.
Well, during the judicial process to obtain the annulment of the civil marriage we find out that woman met other American that is better looking and has more cash, so she goes to live with that guy or the whole idea was for the woman to be able to work and live in U.S. and never was in love. All was a scam for the U.S. citizen.
This story happens in our law firm at least 7 times per month.
Legally talking the process to file is an annulment of marriage, however is important to know the timeframes between the marriage and the moment she left home or change her behavior. Also, sometimes, the woman disappears in U.S. and no one knows where she is, in that situation process can take longer because the notices that need to be published. In other cases, if a time has passed, the option is a divorce.
A DIVORCE OBTAINED IN THE U.S. OF A MARRIAGE IN COLOMBIA IS NOT VALID, YOU WILL APPEAR MARRIED HERE AND IN THE FUTURE YOU MAY HAVE PROBLEMS.
It is important to say that in the law firm we have been able to find that woman has a past, criminal records, was previous married, or had common law marriage and never mentioned, and sometimes she has kids and says they are their brother.

This is a very common question coming from US clients. Normally they get married here in Colombia and return to the US to wait for the visa process. Because the immigration process takes time, relationship may end so US clients believe that the marriage is dissolved automatically based on the time of separation or because never lived together. However, they answer is NO.
A MARRIAGE IN COLOMBIA DOESNT END AUTOMATICALLY AFTER PEOPLE BREAK UP, you need to hire a lawyer in Colombia to represent you in a process of divorce.
The divorce can be done using non-contested procedure in case parties agree to have the Colombian marriage ended, or the trial divorce which in that case is the judge that decides and signs the divorce according to the cause and evidence.
It has happen to foreign clients, that years later after they broke up with their Colombian wife’s, they want to marry again and they need a divorce but there is no clue of where is the wife. In that case is only in a trial divorce that judge can sign the divorce and terminate the Colombian marriage.
Something important a USA DIVORCE OF A COLOMBIAN MARRIAGE DOESN’T END A MARRIAGE DONE IN COLOMBIA. The only authority is a Colombian family court because the marriage was done in Colombia and one of the parties was Colombian.
The law authorizes that a Colombian marriage can be terminated for many causes but the specific one based on the time, requires 2 years of not have lived together. Once proved in trial, family judge will sign the divorce.
